VIRGIN VACATIONS' SWEEPSTAKES RULES NO PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE. SWEEPSTAKES ENTRY All existing newsletter recipients, and any person who signs up to receive the Virgin Vacations' weekly newsletter becomes eligible to win. Enter online on www.virginvacations.com. All entries become the exclusive property of Virgin Vacations and will not be acknowledged or returned. Limit, one entry per person. Neither sponsor nor its agencies is responsible or liable for (i) lost, late, incomplete, misdirected, or not received entries; (ii) electronic, hardware or software program, network, Internet, telephone, telecommunications or computer malfunctions, failures or difficulties of any kind; (iii) failed, incomplete, garbled or delayed computer transmissions; (iv) any printing or typographical errors in any sweepstakes materials; or (v)any condition caused by events beyond the control of Sponsors that may cause the sweepstakes to be disrupted or corrupted. PRIZE DETAILS Every month for twelve months, beginning January 2005 and ending December 2005, Virgin Vacations will be giving away a sweepstakes package for two (2) people. Packages will vary monthly, and actual value will vary based on actual itinerary. Any applicable fees, surcharges, service charges or passenger facility charges are the responsibility of the winner. All insurance, federal, state and local taxes, if any, and gratuities, meals, incidentals, and any other unspecified expenses shall be the sole responsibility of the winner. Prizes are transferable. No prize substitution or cash redemption allowed by winners. Sponsors reserve the right to substitute prize of equal or great value if advertised prize becomes unavailable. All prizes are provided "as is" and without any warranty of any kind. Limit one prize per household/family. DRAWING AND AWARDING OF PRIZES On or about the 15th of each month, a random drawing will be held from among all eligible entries received by Sponsors, whose decisions will be final in all matters relating to this sweepstakes. Winners will be notified by email. Winner has 30 days to respond to the email. Failure to do so will cause the prize to be forfeited and awarded to an alternate winner. Each winner may be required to sign an affidavit of eligibility (which affirms that he/she has complied with these rules) as well as a liability release, and where legal, a publicity release, each of which, if issued, must be completed, signed and returned within 14 days from date of issuance, or the prize will be forfeited and awarded to an alternate winner. If any prize notification or attempted notification is returned as undeliverable, prize will be forfeited and may be awarded to an alternate winner. Except where prohibited, acceptance of a prize constitutes winner's consent to use of his/her name and/or photograph without further compensation for advertising, promotional and publicity purposes by Sponsors. By accepting prize, each winner acknowledges compliance with these official rules. ODDS Odds of winning depend on the number of eligible entries received monthly. ELIGIBILITY Sweepstakes open to legal U.S. AND CANADIAN residents 18 years of age or older. Employees and agents of Sponsors or their parents, affiliates, agencies, distributors, wholesalers and retailers, and members of such employees' immediate families and individuals living in the same household, are not eligible to win. TRAVEL TERMS Your sweepstakes package will be valid for travel for one year from the date of issue, and the fair market value will change monthly, based on the particular package. Holiday and summer blackouts will apply. Validity dates will run between low and shoulder seasons, however, Virgin Vacations will make every effort to accommodate your request. When redeeming package, you will be advised of the dates of travel that are open to you. Once reservations are confirmed, they are non-changeable, non-endorsable and non-transferable. All arrangements are subject to availability and space capacity is controlled. However, Virgin Vacations will make every effort to accommodate your request. The successful winners and their companions must travel together. If winners are unable to travel by date indicated, prize will be forfeited. Winner's guest must be 18 years of age or older if not a member of winner's immediate family, and will be required to execute and return a liability/publicity release (which must also be signed by such guest's parent or legal guardian, if minor) prior to travel. Winner and guest must travel together on the same itinerary including the same departure date, destination and return dates. Sponsors are not liable for expenses incurred due to flight cancellations or flight delays. Passengers are responsible for transportation to and from the airport that prize is valid from. OTHER CONDITIONS Virgin Vacations may modify, rescind, cancel or revoke the promotion at any time in it's sole discretion without notice or liability. By entering, entrants release Virgin Vacations and their parents, affiliates, agencies, distributors, wholesalers, and retailers, and each of their officers, directors, agents and employees, from any and all liability for injuries, losses or damages of any kind resulting from participation in the sweepstakes and/or acceptance or use (or misuse) of a prize , including any indirect, incidental, consequential or punitive damages. Entrants who attempt to tamper with this sweepstakes in any way shall be disqualified. All federal, state and local laws and regulations apply. Additional restrictions may apply. The Internal Revenue Service requires Form 1099-MISC to be issued and filed for each recipient who received a prize/award if the annual aggregate is at least $600 or more. The recipient is responsible for any income tax liability and should consult their tax advisor for the proper tax treatment of this income on their tax return.
